Chapter 1 General Provisions

Article 2 These regulations apply to the leading bodies and leading cadres of Party organs, people's congress organs, administrative organs, CPPCC organs, judicial organs, and procuratorial organs at all levels.
The leading bodies and leading cadres of people's organizations, state-owned and state-controlled enterprises (including state-owned and state-controlled financial enterprises), and public institutions shall implement these regulations by reference.
Article 3 To implement the responsibility system for building a clean and clean government, we must be guided by Deng Xiaoping Theory and the important thought of the "Three Represents", thoroughly implement the Scientific Outlook on Development, insist that the party should manage the party, govern the party strictly, and insist on treating both the symptoms and the root causes and comprehensive management. , pay attention to both punishment and prevention, focus on prevention, steadily promote the establishment of a system of punishment and prevention of corruption, and ensure the implementation of the decisions and arrangements of the Party Central Committee and the State Council on the construction of a clean and honest government.
Article 4 To implement the responsibility system for the construction of a clean and honest party, we must adhere to the unified leadership of the party committee, the party and the government should be jointly managed, the discipline inspection commission should organize and coordinate, and the departments should take their own responsibilities, relying on the support and participation of the masses. It is necessary to take the construction of party conduct and clean government as an important part of party construction and political power construction, incorporate it into the management of the leadership team and leading cadres, and closely integrate it with economic construction, political construction, cultural construction, social construction, ecological civilization construction and business work, and deploy together. , to implement together, to check together, and to evaluate together.
Article 5 To implement the responsibility system for building a clean and clean government, we must adhere to the combination of collective leadership and individual division of labor and responsibility.
Chapter II Responsibilities
Article 6 The leadership team shall assume overall leadership responsibility for the construction of a clean and honest party within the scope of its duties.
The main person in charge of the leadership team is the first person responsible for the construction of a clean and clean government within the scope of their duties, and should personally deploy important work, personally inquire about major issues, personally coordinate key links, and personally supervise the handling of important cases.
Other members of the leadership team, according to the division of work, assume the main leadership responsibility for the construction of a clean and honest party within the scope of their duties.
Article 7 The leading group and leading cadres shall undertake the following leadership responsibilities in the construction of a clean and honest party:
(1) Implement the deployment and requirements of the Party Central Committee, the State Council, the higher-level party committees (party groups), the government, and the discipline inspection and supervision organs on the construction of a clean and clean government, and study and formulate work plans, objectives, and specific measures for the construction of a clean and clean government based on actual conditions. (3) Implementing laws and regulations on party conduct and clean government, promoting institutional innovation, deepening institutional and mechanism reforms, and preventing and curbing corruption at the source;
(4) Strengthen the restriction and supervision of power, establish and improve the power structure and operation mechanism in which decision-making power, execution power and supervision power are mutually restricted and coordinated, and promote the procedure and openness and transparency of power operation;
(5) Supervising and inspecting the construction of a clean and clean government in the region, department, and system, and the clean government of lower-level leading groups and leading cadres;
(6) Selecting and appointing cadres in strict accordance with regulations, preventing and correcting the unhealthy style of selecting and employing personnel;
(7) Strengthen the construction of work style, correct the unhealthy style that damages the interests of the masses, and effectively solve the outstanding problems in the party style and government style;
(8) Lead, organize and support the law enforcement agencies to perform their duties in accordance with discipline and law, listen to work reports in a timely manner, and effectively solve major problems.
Chapter 3 Inspection, Assessment and Supervision
Article 8 The party committee (party group) shall establish an inspection and assessment system for the responsibility system for the construction of a clean and honest government, establish and improve the inspection and assessment mechanism, formulate the evaluation standards and index systems for the inspection and assessment, and clarify the content, methods and procedures of the inspection and assessment.
Article 9 The party committee (party group) shall establish and improve the leading group for the construction of the responsibility system for the construction of a clean and honest party, responsible for the inspection and assessment of the implementation of the responsibility system for the construction of a clean and clean government of the lower-level leading group and leading cadres.
Article 10 The inspection and assessment work shall be carried out once a year. The inspection and assessment can be carried out in conjunction with the assessment of the work objectives of the leadership team and leading cadres, the annual assessment, and the inspection of the construction of the punishment and corruption prevention system, or special inspections and assessments can be organized.
The inspection and assessment results shall be reported to the party committee (party group) at the same level in a timely manner.
Article 11 The party committee (party group) shall report the inspection and assessment results within an appropriate scope. Problems found in the inspection and assessment should be studied and solved in a timely manner, and rectification and implementation should be urged.
Article 12 The party committee (party group) shall establish and improve the system for the use of inspection and assessment results. The inspection and assessment results serve as an important basis for the overall evaluation of the leadership team and the performance evaluation of leading cadres, rewards and punishments, and selection and appointment.
Article 13 Disciplinary inspection and supervision organs (organizations), organize personnel departments to assist party committees (party groups) at the same level to carry out inspections and assessments of the implementation of the responsibility system for building a clean government, or to carry out inspections according to their duties.
Article 14 The Standing Committee of the Party Committee shall take the implementation of the responsibility system for the construction of a clean and clean government as an important part of its work report to the plenary meeting of the Party committee at the same level.
Article 15 The implementation of the responsibility system for the construction of a clean government by leading cadres shall be listed as an important part of the democratic life meeting and debriefing of work and integrity, and shall be reviewed in their own units and departments.
Article 16 The party committee (party group) shall report on the implementation of the responsibility system for building a clean and clean government, and report annually to the higher-level party committee (party group) and discipline inspection commission.
Article 17 The inspection teams of the Party committees of the central and provincial, autonomous regions, and municipalities directly under the Central Government shall, in accordance with the relevant regulations on inspection work, strengthen inspection and supervision of the leadership of relevant party organizations and their members in implementing the responsibility system for building a clean and clean government.
Article 18 The party committee (party group) shall, in light of the actual conditions of the region, department, and system, establish a social evaluation mechanism for the construction of a clean and honest government, such as interviews, forums, and social questionnaires, mobilize and organize party members and the masses to participate in an orderly manner, and widely accept supervision.
Chapter IV Responsibility Investigation
Article 19 If the leading group or leading cadre violates or fails to correctly perform the duties stipulated in Article 7 of these regulations, and falls under any of the following circumstances, they shall be held accountable:
(1) Ineffective leadership in the work of building a clean and honest party, so that the unhealthy practices that are explicitly prohibited within the scope of duties cannot be effectively managed, resulting in adverse effects;
(2) Failing to communicate, implement, arrange, supervise and implement, or refuse to handle matters within the scope of responsibility for building a clean and clean government assigned by a higher-level leading authority;
(3) Concealing and failing to report serious violations of discipline and law found in the region, department, or system, or suppressing the case without investigating;
(4) Neglecting supervision and management, resulting in serious violations of discipline and law by members of the leadership team or subordinates directly under their jurisdiction;
(5) Selecting and appointing cadres in violation of the regulations, or oversight or mistakes in the employment of personnel cause adverse effects;
(6) Allowing, sheltering, or condoning subordinates to violate laws and regulations such as finance, finance, taxation, auditing, statistics, etc., and commit fraud;
(7) There are other acts that violate the responsibility system for building a clean government.
Article 20 The leadership team has the circumstances listed in Article 19 of these regulations. If the circumstances are relatively minor, they shall be ordered to make a written inspection; if the circumstances are serious, they shall be criticized in a circular; if the circumstances are serious, adjustments shall be made.
Article 21 Leading cadres who have the circumstances listed in Article 19 of these regulations, if the circumstances are relatively minor, shall be given criticism and education, admonishment to talk, and ordered to make a written inspection; if the circumstances are more serious, they shall be criticized in a circular; if the circumstances are serious, they shall be given party discipline Political and disciplinary sanctions, or organizational measures such as adjustment of positions, orders to resign, dismissal, and demotion. Those suspected of committing a crime shall be transferred to judicial organs for handling in accordance with the law.
The above methods of accountability can be used individually or in combination.
Article 22 If the leading group or leading cadre has the circumstances listed in Article 19 of these regulations, and has one of the following circumstances, they shall be held accountable more severely:
(1) Covering up or shielding problems that occur within the scope of duties;
(2) Interfering with or hindering the investigation and handling of accountability.
Article 23 If a leading group or leading cadre falls under the circumstances listed in Article 19 of these Regulations, and has one of the following circumstances, the responsibilities may be mitigated or mitigated:
(1) Timely and truthfully reporting the problems that occur within the scope of duties and taking the initiative to investigate and correct them, so as to effectively avoid losses or restore the impact;
(2) Conscientious rectification, and the effect is obvious.
Article 24 If the leading group and leading cadres violate these regulations and need to find out the facts and be held accountable, the relevant organs or departments shall investigate and deal with them according to their duties and powers. Among them, if it is necessary to investigate the responsibility of party discipline and government discipline, the discipline inspection and supervision organ shall handle it in accordance with the investigation and handling procedures of party discipline and political discipline cases; if it needs to be handled in an organization, the organization and personnel department or the discipline inspection and supervision organ in charge of the investigation together with the organization and personnel department shall follow the relevant authority and procedures. handle.
Article 25 In carrying out accountability, it is necessary to seek truth from facts, and to distinguish between collective and individual responsibilities, as well as major leadership responsibilities and important leadership responsibilities.
When investigating collective responsibilities, the main person in charge of the leadership team and the members of the leadership team who are directly in charge assume the main leadership responsibility, and other members of the team participating in the decision-making assume important leadership responsibilities. Those who put forward clear objections to wrong decisions but are not adopted shall not assume leadership responsibilities.
If the wrong decision is made or approved by the individual leading cadre, the individual leading cadre shall be held accountable.
Article 26 The implementation of the responsibility investigation shall not be exempted from investigation due to the change of the leading cadre's job position or position. Those who have retired but should be held accountable in accordance with these regulations must still be held accountable.
Article 27 The leadership team and leading cadres who are held accountable shall be cancelled the qualifications for the annual evaluation and selection of various advanced types.
Leading cadres who are individually ordered to resign or remove from their posts shall not assume leadership positions equivalent to their original positions within one year; those who are demoted shall not be promoted within two years. At the same time, those who are subject to party discipline and government discipline and organizational treatment shall be executed according to the longer period of influence.
Article 28 Disciplinary inspection and supervision organs at all levels shall strengthen the supervision and inspection of the implementation of accountability by lower-level party committees (party groups) and governments, and shall promptly urge lower-level parties if they find that there are problems that should be investigated but have not been investigated or the decision on accountability and handling is not implemented. The party committee (party group) and the government should correct it.
Chapter V Supplementary Provisions
Article 29 All provinces, autonomous regions, municipalities directly under the Central Government, the central and state organs and ministries and commissions may formulate implementation measures in accordance with these regulations.
Article 30 The Central Military Commission may formulate specific regulations in accordance with these regulations and in light of the actual conditions of the Chinese People's Liberation Army and the Chinese People's Armed Police Force.
Article 31 The Central Commission for Discipline Inspection and the Ministry of Supervision are responsible for the interpretation of these regulations.
Article 32 These regulations shall come into force on the date of promulgation. The "Regulations on Implementing the Responsibility System for the Construction of a Clean and Clean Party" promulgated in November 1998 shall be repealed at the same time.
